This product contains three comprehensive templates which can be customised and used as evidence of a clearly documented Third Party Agreement. [DOC]

Under the Standards for RTOs 2015, agreements between the RTO and third parties must ensure the services delivered by third parties comply with the Standards at all times. You must have a written agreement with any third party (either an RTO or non-RTO) that delivers services on behalf of you, the Principal RTO.

Where the arrangement occurs with another RTO, that Third Party RTO must have the training product on scope. The exception to this is VET delivered in secondary school settings, where the school provides the course although it does not have the relevant course on its scope.

While some RTOs closely manage third party arrangements, others adopt a more flexible approach, however the more flexible the arrangement, the greater the risk to your RTO. With this in mind, Velg Training has developed these templates to assist each party in understanding their obligations and responsibilities when entering an agreement.

There are THREE templates included in this product:

1. Third Party Agreement template to represent training and assessment and/or education support services in respect of Principal RTOs with the training product ON scope.

2. Third Party Agreement template to represent training and assessment and/or education support services in respect of School Principal RTOs with the training product NOT on scope.

3. Third Party Agreement template to represent recruitment services only.

These templates have been developed to reflect the most common sets of circumstances when it comes to Third Party arrangements. They are however fully customisable and should be adjusted to reflect the specific arrangements between you (the Principal RTO) and the Third Party. These templates have been designed for:

a) an RTO, as the Principal Party, who DOES have the training product(s) on its scope of registration, to use when entering into a third party arrangement with:

  • a Third Party RTO that DOES have the same training product(s) on its scope of registration, or
  • a non-RTO Third Party.

b) a School RTO, as the Principal Party, who DOES NOT have the training product(s) on its scope of registration, to use when entering into a third party arrangement with a Third Party RTO who DOES have the training product on its scope of registration.

Once completed and customised, the written agreement should explain in detail the obligations and responsibilities expected from each party including all monitoring arrangements that apply.
